Points you may Wish to Keep in Mind with Respect to Compensation Claims

Compensation claims may be made when you have been injured or suffered some other loss as a result of someone else's negligence when they have failed in a duty of care they owe you. The following are some points you may wish to bear in mind if you believe you are entitled to such compensation:
  • you may be convinced of the other person's liability, but the law relating to personal injury claims is sometimes complicated;
  • pursuing the claim under your own steam, therefore, might not only prove difficult, but may also result in your recovering only a part of the compensation to which you might be entitled;
  • in some of the more common types of claim such as those for car accident compensation, for example you may come under pressure from others (such as your motor insurers) to settle any dispute quickly, rather than engage the services of a solicitor;
  • engaging a solicitor to pursue your claim on your behalf may represent not only the way to successfully negotiating the detail of the law itself, but also helping to ensure that you achieve a full and fair amount of compensation for your injuries or loss;
  • this may especially be the case if the solicitor you instruct is a specialist personal injury lawyer;
  • typically, such lawyers are not only qualified in the relevant aspects of the law, but also have many years experience in negotiating compensation claims;
  • some may also have the backing of membership of and accreditation by the professional Association of Personal Injury Lawyers;
  • they are also authorised and regulated by the professional standards watchdog, the Solicitors Regulation Authority;
  • as you outline the circumstances surrounding any accident or incident, one of the first pieces of advice that your solicitor may typically offer is whether there is any basis for a claim for compensation;
  • if your own actions or inaction may have played some part in the injuries or loss you suffered, you may need to accept that you were at least partly responsible and share an element of contributory negligence thus proportionately reducing the amount you may claim in compensation;
  • no two incidents or accidents may be exactly the same, of course, and it is the particular set of circumstances surrounding your own claim that is likely to determine the level of any compensation you may be awarded;
